Court Condemns Glorification of Bulldozer Justice, Announces Plans for Guidelines; Next Hearing on October 1
The Supreme Court has made a big intervention regarding Bulldozer Justice. The Supreme Court has banned demolition across the country till further orders. However, this order will not apply to illegal encroachments on public roads, streets, water bodies, footpaths, railway lines etc. The Supreme Court said that glorification and display of bulldozer justice cannot be allowed in the country. The court also said that we will make guidelines regarding bulldozers. The next hearing in this case will be on October 1.
Today, the Supreme Court heard the petition filed by Jamiat Ulema-e-Hind against the bulldozer action in Uttar Pradesh and other states. A bench of Justice BR Gavai and Justice KV Vishwanathan heard the case.
Justice Gavai said that we have made it clear that we will not come in the way of unauthorized construction, but the executive cannot be a judge.
At the same time, Justice Vishwanathan said that external noise does not affect us. We will not go into the question at this time which community it is, if there has been a single incident of illegal demolition, then it is against the basic spirit of the Constitution.
At the same time, he said let me make it clear that we will have instructions, they are being called guidelines. Demolition without the permission of the court should be stopped till the next date.
Senior Advocate CU Singh told the court that demolition is happening every day. At the same time, SG Tushar Mehta said that notice was given in 2022 and action was taken after that. Meanwhile, crimes were committed. On this, Justice Gavai said that the state government should be informed.
The Supreme Court said that the glorification of Bulldozer Justice should stop. Also, the Supreme Court told SG Mehta that we need your help and we can also seek assistance from the Election Commission. SG Mehta said that how can the court stop demolition according to the procedure established by law. However, the Supreme Court did not agree with this.
