Implementation of Section 163 in Delhi with Restrictions on Protests and Gatherings, But Why?

Section 163 of BNSS has been implemented at many places in Delhi for the next 6 days. According to the notice of Delhi Police, apart from New Delhi, Central Delhi and North Delhi, Section 163 will be applicable for 6 days on all the borders of Delhi. From 30 September to 5 October, there will be a ban on sit-ins and demonstrations at these places and there will also be a ban on bringing any kind of weapon.

Delhi Police has stated in the notice that many organizations have called for organizing various programs including protests in the Delhi area in the first week of October 2024. Due to issues like the Waqf Amendment Bill (proposed), the Shahi Idgah issue and MCD Standing Committee elections, the general atmosphere in Delhi is sensitive from the point of view of law and order. Along with this, the announcement of DUSU results is also pending. In such a situation, the Delhi Police Commissioner has ordered to implementation of Section 163 in the given area.

The notice said that due to Gandhi Jayanti on October 2, there will be heavy movement of VVIP persons in New Delhi and Central District. Also, assembly elections are going on in Jammu and Kashmir and Haryana. Due to this, there is also a need to constantly check the movement of people and vehicles from the borders of Delhi. Due to these elections, areas inhabited by migrants from the states may be particularly vulnerable due to infiltration and provocation at the behest of anti-social elements who aim to disturb public order in the national capital. Along with this, the festival season is also near, Dussehra and Diwali are also coming.

Delhi Police Commissioner Sanjay Arora has said in the order that Section 163 will remain in force from 30/09/2024 to 05/10/2024 in New Delhi, North and Central districts, besides all police stations having territorial jurisdiction on the borders of Delhi. During this time, these activities will be banned-:

Gathering of five or more unauthorized persons.

Carrying firearms, banners, placards, sticks, spears, swords, lathis.

Staging dharna etc in any public area.

Violation of any order shall be punishable under section 223 of Indian Justice Code 2023, the Delhi Police notice said.
