Sanjauli Masjid Case: Shimla Court Rejects Muslim Organization's Petition; Orders Removal of Illegal Structures
District Court Upholds Municipal Commissioner's Decision; Work to Remove Unauthorized Floors to Continue;
The petition of the All Himachal Muslim Welfare Organization in the Sanjauli Masjid case has been rejected by the Shimla District Court. The court has upheld the decision of the Municipal Commissioner's court. According to this, the work of removing the illegal part from Sanjauli Masjid will continue. The Muslim Welfare Organization had challenged the decision of the Municipal Commissioner's court in the district court.
Earlier, the Municipal Commissioner's court had ordered the removal of the three floors above the mosque within two months on the basis of the affidavit of the Sanjauli Masjid Committee. The Muslim Welfare Organization had approached the District Court against this decision. At the same time, the case regarding Sanjauli Masjid is pending in the Municipal Commissioner's court and the next hearing is to be held on December 6.
Vishwa Bhushan, the lawyer of the petitioner All Himachal Muslim Welfare Organization, said that the court has rejected his petition. On the question of challenging this matter in the High Court, Vishwa Bhushan said that he will decide after reading the order. Vishesh Bhushan said that he had challenged the eligibility of Sanjauli Masjid Committee and its president Mohammad Latif to give affidavit in the court.
Sanjauli Masjid Committee president Mohammad Latif said that the court has rejected the petition of Muslim Welfare Organization. Now the decision of the Municipal Corporation Commissioner regarding Sanjauli Masjid will remain intact. Latif said that the work of removing the roof and a temple above the mosque has been done. Also, due to non-availability of labour, the work of removing the illegal part of the mosque will not be done till March.
At the same time, the lawyer of the residents, Jagatpal, has welcomed the decision of the district court. He said that in this entire matter, there are orders of the High Court that this matter should be settled as soon as possible. In such a situation, he has expressed hope that the final decision of the Municipal Corporation will come on the matter.
